These Terms and Conditions (“Terms”) govern:

the access to and use of the Fynex Capital website and the Fynex App (the “Service”);
any related agreement or legal relationship between the User and the Owner.

Capitalized terms are defined where first mentioned.

Users are required to read these Terms carefully.

Nothing in these Terms creates any relationship of employment, agency, partnership, or joint venture between the parties.

2. Information about the Service

Fynex Capital operates as a technology and educational platform. It is not a broker, not an investment advisor, and not an Introducing Broker. It does not execute trades, does not hold or handle client funds, and does not provide investment advice.

The Service provides informational and educational tools related to trading, including but not limited to:

educational courses and quizzes on how markets work;
financial news and analytical content.

The Service does not provide investment advice, portfolio management, or personalized financial recommendations, and does not handle or hold client funds.

3. What the User Should Know at a Glance

Certain provisions may apply only to specific categories of Users; such limitations are explicitly stated.

In the absence of explicit limitations, all provisions apply to all Users.

Access to and use of the Service is restricted to Users aged 18 years or older.

Nothing in these Terms affects any mandatory consumer rights that may apply under the law of the User’s country of residence.

4. Conditions of Use

Unless otherwise specified, these Terms apply to all use of the Service.

By accessing or using the Service, Users confirm that:

they are legally capable of entering into binding agreements;
they are at least 18 years old;
their use of the Service complies with applicable laws and regulations in their jurisdiction.

The Owner reserves the right to deny access to the Service where these conditions are not met.

5. Account Registration

During registration, Users must provide accurate, complete, and up‑to‑date information. Users are responsible for maintaining the confidentiality of their login credentials and for all activities carried out under their account.

Users must promptly notify the Owner at help@fynexcapital.com if they suspect unauthorized access, misuse, or breach of their account or personal data.

Use of certain parts of the Service may be available without registration, with limited functionality.

6. Account Termination, Suspension, and Deletion

Users may request termination of their account at any time by contacting the Owner.

The Owner reserves the right, at its sole discretion and without prior notice, to suspend or delete a User account where:

these Terms are violated;
unlawful, abusive, or fraudulent activity is suspected;
the User’s conduct may expose the Owner or third parties to legal or regulatory risks.

Suspension or deletion of an account does not entitle the User to any compensation or reimbursement.

7. Content on the Service

Unless otherwise specified, all content available through the Service is owned by the Owner or its licensors.

While reasonable efforts are made to ensure that content does not infringe applicable laws or third‑party rights, the Owner does not guarantee the absence of errors or inaccuracies.

Users are encouraged to report any alleged infringement or unlawful content using the contact details provided.

8. Intellectual Property Rights

All intellectual property rights related to the Service, including but not limited to texts, graphics, software, algorithms, trademarks, and logos, are exclusively owned by the Owner or its licensors.

The Service may contain links to third‑party websites or services, including those operated by third‑party broker partners.

The Owner has no control over such external resources and is not responsible for their content, availability, or practices. Users access external resources at their own risk.

Users must use the Service in compliance with these Terms, applicable laws, and third‑party rights.

The Owner reserves the right to take appropriate measures to protect its legitimate interests, including restricting access to the Service or reporting unlawful conduct to competent authorities.

11. Risk Acknowledgment

Trading in financial markets involves significant risk of capital loss.

The Service is provided for informational and educational purposes only. Users acknowledge that any trading decision is made at their own discretion and risk.

Users are encouraged to acquire adequate financial knowledge and to consult independent educational resources and regulated brokers’ risk disclosures before engaging in trading activities.

12. Anti‑Money Laundering (AML)

The Owner may be required to comply with applicable anti‑money‑laundering and counter‑terrorist‑financing regulations.

Where required by law, the Owner may cooperate with regulated partners and competent authorities.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict‑of‑laws rules, and without prejudice to any mandatory consumer protection rules applicable in the User’s country of residence.

14. Jurisdiction

For disputes arising from or related to these Terms:

consumers resident in the European Union may bring proceedings before the courts of their place of residence, where such right is granted by applicable EU law;
in all other cases, exclusive jurisdiction shall lie with the state and federal courts located in Wyoming, USA.

15. Amicable Dispute Resolution

Users are encouraged to contact the Owner to seek an amicable resolution of disputes.

16. Changes to These Terms

The Owner reserves the right to modify these Terms at any time. Continued use of the Service after changes are published constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

18. Payments, Subscriptions and Refunds

Access to the educational content and to the news feed of the Service is provided free of charge.

Certain optional features may be offered against payment. Where they are purchased through the Apple App Store or the Google Play Store, the purchase is processed by the relevant store under its own terms, and any auto‑renewing subscription is managed, renewed, and cancelled by the User through the settings of the store account. Cancellation takes effect at the end of the billing period already paid for.

Where optional features are purchased directly from the Owner, payments are processed by third‑party payment providers. The Owner does not store full payment card details.

Except where a refund is required by applicable law or by the rules of the store through which the purchase was made, payments are non‑refundable. Refund requests should be sent to help@fynexcapital.com.

Prices may be updated at any time. Changes never affect a billing period already paid for.
